Is the state of Maine a stop and ID state?
Maine does not have stop and ID laws, so individuals in Maine are not obligated to provide identification when approached by law enforcement officers.
You have the right to remain silent and cannot be punished for refusing to answer questions. If you wish to remain silent, tell the officer out loud. In some states – including in Maine – you must give your name if asked to identify yourself.
As a passenger in a vehicle, if the police do not have reasonable suspicion to believe that you have committed a crime, it is legal to refuse to show identification. Reasonable suspicion means that the officer must have a reasonable belief that you have committed a crime or are about to commit a crime.
A person is guilty of a Class E crime if a law enforcement officer has probable cause to believe the person violated or is violating this Title and the person intentionally fails or refuses upon request to give the person's correct name, address or date of birth to a law enforcement officer.

In Maine, probable cause generally exists when there is enough information for a reasonably cautious person to believe a crime is being or was committed.
How the Exclusionary Rule Works in Mane. The exclusionary rule is actually very simple. If the police, during the course of an investigation, violate one of your constitutional rights, then any evidence that they find as a result of that violation is excluded from being heard in court at your trial.
Any person to whom a law enforcement officer is authorized to issue or deliver a summons pursuant to subsection 1 who intentionally fails or refuses to provide the officer reasonably credible evidence of the person's correct name, address or date of birth commits a Class E crime, if the person persists in that failure ...

Your REAL ID compliant driver's license or identification card, and other federally accept- ed forms of identification, can be used to board a commercial flight or visit a secure federal building on or after May 3, 2023. Visit https://www.dhs.gov/real-id for more REAL ID information.
